What Is The Maximum Time Of Human Pregnancy?

My question is from Dr Rizwan and Dr KK And from all other respected members on this forum

I read a book masley masail this book actual name i forget but this book is very famous and answer by very famous ulmas on different issues related to our religion and our life 

In one question asked by Imam Abu Hanifa

ha agur najayz baby agur husband k zinda hoty i think pyda ho jay tu oska bap wo he kehlway ga es ki ek misaal or hudess mujy b yad thi bhool ghiya pury ye bot nazak mohamilaat hen kisi mofti alam deen k bina ni solajty .

baki 18 ya 19 month k bahd pyda hony wala najayz babay kis tura phylly shohar ka ho sukta hy . ye or bat hy k wo jot mot ka oska nam documents meh ksisi tura dy dy baby k achy future k leye .

I think you did not read my question properly my question is on the above sistuation weather Imam Abu Hanifa Opinion is right or wrong on 18 to 20 month preganancy it is possible on medical point of view , a woman can have a baby in her womb 18 to 20 months or not .........?

g ni pregnency 9 months sy oper ni hoti ha ek ad week oper ho jay narmal pregnency tu 9 month meh hoti hy pur 7th month ka baby b zinda reh jata hy agur delivery ho jay pur ap keh rhy ho medicaly ye btayn k keya ek baby 18 month ya 20 month uterus meh reh sukta hy k ni  eska juwab ni he hy .

Well, Maximum pregnancy could be up to 38 weeks. Thats is less than 20 months. I have not heard any case of having child birth after so much time. 

Sorry I don't know why Imam Abu Hanifa said this. I could not understand. Will you help me out to explain the logic?

I also dont no what is the logic behind this, the book i read never go in details whats the logic on this matter , In a GEO tv discussion program Dr Israr Ahmed also mention this point , But  Imam Abu Hanifa is a great aalim may be any logic there famous ulmas may some light on this matter ,

Now I understood. That was a misconception. 

The explanation is if a women suppose gets married with another man after the demise of his first husband. She passed the era of Iddat as well. If a child is born then who would be called his father, either first one or second one.

Islam has given a clear demarcation and Imam Abu Hanifa told in this referance that if the child is born after two and a half year or as some says he told after 20 months of the demise of her first husband then the child must get the name of her second husband. However if he will be born before 20 months then the name of first husband should be given to him.

During the caliphate of Hadrat `Uthman (may Allah be pleased with him) a person married a woman from the Juhainah tribe, and just six months after the marriage she gave birth to a healthy and sound child. The man took the case before Hadrat `Uthman, who declared the woman to be an adultress and ordered that she be stoned to death. On hearing this Hadrat `Ali immediately came to Hadrat `Uthman and asked: What sort of a decision have you given ? He replied: She has given birth to a sound child six months after marriage. Is it not a clear .proof of her being an adultress? Hadrat `Ali did not agree, and recited the three above mentioned verses in their sequence. In Surah Al-Baqarah Allah says: 'The mothers shall suckle their children for two whole inyears, if the fathers desire the suckling to be completed." In Surah Luqman it is said: "And his weaning took two years," and in Surah AI-Ahqaf: "And his bearing and his weaning took thirty months." Now, if two years of suckling are taken away from 30 months, six months of bearing remain. This shows that the minimum period of pregnancy in which a sound child can be born is six months. Therefore, the woman who has given birth to a child six months after the marriage cannot be declared an adultress . On hearing this reasoning of Hadrat 'Ali, Hadrat 'Uthman admitted that he had not considered that thing at all. Then he recalled the woman and changed his decision. According to another tradition, Ibn 'Abbas also supported the reasoning of Hadrat 'Ali and then Hadrat 'Uthman changed his decision. (Ibn Jarir, Ahkam al-Qur an by al-Jassas Ibn Kathir). 

The following legal injunctions are derived from the three verses when they are read together: The woman who gives birth to a sound and complete child in less than six months after marriage (i.e. in a proper delivery and not abortion) will be declared an adultress and her child's lineage from her husband will not be established. 
(2) The woman who delivers a sound and complete child six months or more after marriage, cannot be accused of adultery only on the basis of the child birth, nor can her husband have the right to slander her, nor can he refuse to acknowledge fatherhood of the child; the child will certainly be recognized as his, and the woman will not be punished. 
(3) The maximum period for fosterage is two years. If a woman has suckled a child after this age, she will not be regarded as his foster mother, nor will the injunctions pertaining to fosterage (An-Nisa: 23) be applicable to her. In this regard, Imam Abu Hanifah has out of caution proposed the period of two and a half years instead of two years so that there remains no chance of error in a delicate matter like the prohibition of the foster relations. (For explanation, see E N. 23 of Surah Luqman). Here, it would be useful to know that according to the latest medical research a child needs at least 28 weeks to remain in the mother's womb to be developed and delivered as a living baby. This period amounts to a little more than 6 months. The Islamic law has allowed a concession of about half a month, because a woman's being declared an adultress and a child's being deprived of lineage is a grave matter, and its gravity demands that maximum period be allowed to save both the mother and the child from its legal consequences. Furthermore, no physician and no judge, not even the pregnant woman herself and the man impregnating her, can know as to when exactly did the conception take place. This thing also demands that a few more days be allowed in determining the minimum Legal period of pregnancy.

qk zahen may yee aata ha k koi aurat bewa ya talaq yafta honey k bad jeb us k yeehen suppose 18 months may delivery ho jati ha ,chahee aap is may 4 months eddat ka period laga deen phir bhee 14 months remaining ,to jo child born ho ga wo kis tara say us k ex husband ka khelayee ga.......?

Urdu Translation

Ab main samjha ke ye ghalat concept tha:
Is ke tafseel ye he ki agar aurat shadi kerti hai apne pehle shohar ke inteqaal ke baad, jabke us ne iddat ke din bhe guzaar leye hain aur ek bacha peda hota hai to wo kis ka name use degi apne pehle shohar ka ya phir dosre shohar ka.

Islam ne bohat wazeh andaaz main byan kerdya hai.

Hazrat Usman RA ke dore khilafat main ek aurat ne shadi ke sirf six months ke baad he bacha peda kya to wo aurat Hazrat Usmaan ke paas laye gai. Us Aurat ko Hazrat Usman ne Sangsaar ka hukm sunaya. Hazrat Ali RA ne unhe roka aur Quran ki teen Aayat sunaien.

1.In Surah Al-Baqarah Allah says: 'Maan apne bache ko pore do saal tak apna doodh pelae agar uska shohar ye chahta ho to"
2.In Surah Luqman it is said: "Bache ke weaning yani dodh pelane ka amal do saal hai"
3.In Surah AI-Ahqaf: "Bache ko palne ka aur dodh pelane ka yani nashronuma ka period 30 months hai"
Hazrat Ali ne kaha ke agar doodh pelane ke do saal 30 mah main se nikal deye jaen to baqi 6 monhts bachte hain. Yani man apne bache ke mukamal nashronuma apne pait se shuru kerte hai aut kul doranya pedayish ke baad tak dood pelane ka 30 months he. To 6 monhts kam se kam wo pregnant reh sakti hai. Yani 6 months ke baad agar bacha jane gi to wo paak hi hogi. Agar us se pehle jane gi to zani ho sakti hai. Ye jawab Hazrat Ali ka sunke Hazrat Usman ne apni ghalati ko tasleem kia aur us aurat ko ba izzat bari kerdya.(Ibn Jarir, Ahkam al-Qur an by al-Jassas Ibn Kathir). 

Is tamam guftago se mundarja zeel nukat akhaz hue:
1. Jo aurat 6 months se kam time main shadi ke baad mukamal aur sehatmand bacha jane wo zani ho sakti hai.
2. Jo aurat 6 months ya zayed  time main shadi ke baad mukamal aur sehatmand bacha jane wo zani Hargiz nahi ho sakti
3. Rizayat ka kul doranya 2 saal hai. Is Waqt ke guzarne ke baad agar maan bache ko doodh pelana be shuru kerde tab bhe wo razayat ke  leye ahal nahi. Is maqararah waqt ke guzar jane ke baad razayat ka qanoon lago nahi hoga ( Qanon ki tafseel Al-Nisa 23)

Chunache Imam Abu Hanifah ne qayyas ke zarye do sal ke bajae dhai saal ki choot di take is nazuk masle main koi ibhaam na reh jae or rishtae rizayyat main ko ghalati sar zad na hojae. ( Ye rizaayat ka qanoon quran ke mutabiq soteli maan ke hawale se hai. Yani jab wo apna dodh pelati hai to wo bacha pher razai beta hojata hai lehaza uski soteli behne jo ko razai maa ki betyan honge se nikkah ka ahal nahi hosakta. Taham jitna main samjaha hun, agar wo maan dhai saal ke baad apna doodh kisi bache ko pilae gi to razayat lagu nahi hogi. Wallahul Ilm). For details recite Surah Luqman.

Yahan pe ye batana bohat faede mand hai ke Medical Science ki roo se, Jadid research ne sabit kia ke kam se kam waqt jis main bacha man ke pait main namo pasakta hai wo 28 weeks hain yani 6 monhts se kuch ziada. Aur agar delivery hogai to wo mukamal aur zinda baby hoga taham kamzoor ho sakta hai. Jiske leye incubator waghaira istemal hote hain.
Halan ke Islam ne phir be adhe mahene ki choot dedi yani wo zinda peda ho sakta hai taqreeban sadhe 6 mah main jabke Islam ke mutabiq 6 months ka qanoon hai. Ye sab is leye kya gaya take is nazuk masale main aurat ko mazeed choot dedi jae. Aur Maan bacha dono ko falah naseeb ho.Isi tarhan koi doctor, koi judge ya khud hamla aurat ye andaza nahi laga sakti ke hamal kis din thera hai chunache is nukte ko made nazar rakhte hue Islam ne munasib choot dedi hai.

Maximum Time of Human Pregnancy

Medical point of view se sperm 48 hours tak zindah reh sakte hain aur agar exceptional case bhi ley lein tou phir 72 hours tak... agar shohar k marne k 3 din baad bhi pregnancy hoti hai tab bhi 9 month ma child birth lazmann ho jani chahiyah... maximum 40 weeks excetpional case bhi agar rakh lein ap, lekin 18 months tou impossible hai.

Imam Abu Hanifa bilah shubah buhat bardey Islamic Scholar hain, magar un ka dour scientific nahi tha... yahan baat hai Science ki, tou Science is baat ka jawab Big "NO" ma hi deti hai, Dr. Asrar professional doctor hain tou unhon ne eak dum sahi jawab diya hai, app dunya k kisi bhi doctor k pas chaley jayein app ko yahi jawab miley ga.
